EL SALVADOR: SUSPENSION OF ADMINISTRATIVE AND JUDICIAL TERMS FOR PANDEMIC COVID-19


As a consequence of the Sanitary Emergency State decreed by the government of El Salvador due to the threat of the COVID-19 virus pandemic, the Legislative Assembly by decree No. 599 dated March 20, 2020, suspended the procedural terms and deadlines in the administrative and judicial procedures, regardless of the matter and the instance in which they are found.

 

There are not included in said provision, the procedures, deadlines and sanctions provided for:

 

  • Constitution for administrative detention, the term of inquiring and their hearings.

  • Consumer Protection Law.

  • General Medicines Law.

  • Law of Organization and Functions of the Labor and Social Security Sector

  • General Law of Risk Prevention

  • Law of Constitutional Procedures promoted in the framework of the emergency.


This decree modifies Art. 9 of Decree 593 of March 14, 2020, which already considered the suspension of procedural terms and deadlines granted to individuals in the administrative and judicial procedures in which they participate, but was only applicable to persons that  would be directly affected by the measures decreed by virtue of the sanitary emergency established in said decree; this reform being of a more general nature, with the exceptions indicated above.
