On February 25, 2016, the Congress of the Republic of Guatemala approved the accession of the country to the Trademark Law Treaty (TLC), originally subscribed in Geneva on October 27, 1994; the approval was one of the commitments of Guatemala established in the Free Trade Agreement between Dominican Republic, Central America and the United States of America (DR-CAFTA). The Treaty and its Regulations have not entered into force in Guatemala, since the Executive branch of the country must complete internal and external steps established in the law. So we inform to our clients that the procedures regarding trademark registration and renewal of marks remain the same –for now- in accordance with the Industrial Property Act of Guatemala and its Regulations.
